Comments on Proposed Revisions to the Sanction Guidelines and Procedural Rules
CFP Board accepted comments on proposed revisions to its Sanction Guidelines and Procedural Rules from July 28 through September 21, 2021.
CFP Board requested comments on proposed revisions to its Sanction Guidelines and Procedural Rules. CFP Board is especially interested in comments on:
- The proposed guideline for Failure Timely Report Information to CFP Board, its recommended sanction (a public censure), and aggravating and mitigating factors;
- The proposed guideline for Inaccurate Ethics Declaration, its recommended sanction (a public censure), and aggravating and mitigating factors;
- Whether timely reporting on Form U4 should be considered reporting to CFP Board;
- Related proposed updates to the Procedural Rules that provide for an option to accept an Order of Public Censure for a single incident of Failure to Timely Report Information to CFP Board or Inaccurate Ethics Declaration, in lieu of a hearing before the Disciplinary and Ethics Commission (which involves paying a hearing fee); and
- Whether CFP Board should impose administrative fees for cases involving Failure to Timely Report Information to CFP Board and/or Inaccurate Ethics Declaration.
